What arguments were put forward on behalf of Mr Merritt to support his appeal?
Answer 7.
The arguments of Mr Merritt were as follows:
- the agreement made was not intended to create legal relations as this
was a family agreement;
- the agreement was too uncertain to be enforced;
- Mrs Merritt had given no consideration in return for Mr Merritt’s
promise;
- Section 17 of the Married Women’s Property Act 1882 meant that the
house was jointly owned by Mr and Mrs Merritt.
